The commissioner will be referred to as “The Client”, and ImaBunBun will be referred to as “The Artist” going forward.
Process
The Client sends the Artist their idea detailing the desired content for the commission. Once both parties agree on the content and payment plan of the commission, the Artist will send an invoice to the Client. Once the invoice is paid, the Artist will begin to work on the commission. During each stage, the Artist will send drafts for the Client to approve before moving on to the next stage. Should a situation arise that hinders the Artist from working on the commission, the Client will be contacted & informed of the issue.

The Artist will send the Client rough drafts of the idea(s) and the Client may settle on one of them. The Client can ask for changes to the rough draft until they are satisfied. Once the rough draft is approved, the Artist will move forward and refine the sketch.

Once the refined sketch is approved, the Artist will continue onto the lineart. The Client may only ask for minor revisions during the lineart, which could incur a fee if the revision increases the estimated time to finish the commission.

Once the lineart is approved, the Artist will continue onto flat colors, and finally the rendering before sending in the final work to the Client.
Revisions

The Client may request up to 3 revisions to the refined sketch, free of charge. Should the Client ask for further revisions, there will occur an additional fee per revision of $20.

Small changes such as minor expression adjustments, blush, hand pose, etc will not incur a fee unless repeatedly requested

Should the Artist forget to include elements from the Clients original commission inquiry, the Artist will add them free of charge.

In general, the Client cannot request revisions past the sketching phase unless exceptions are made on the Artists part.
How long a commission takes to complete depends on the commission type, the Client’s response time, revisions, and the Artists workload outside of the commission. If the Artist has no other projects they need to tackle while working on the commission; a sketch could be completed within the day the order is made, while a fully rendered piece with a background could take up to two weeks. The time averages around three weeks +/-. If the Client requires a deadline for the commission, they must discuss it with the Artist in advance.
The Client agrees to let the Artist upload the commission first to their Paywall sites, unless otherwise agreed upon between the Parties. The commission may remain up on the Artist’s paywall site(s) for up to two weeks max, before it’s uploaded publicly. The Client may show the commission privately in the meantime, or use it as an icon/banner, amongst other things. It’s appreciated, but not demanded, that the Client refrains from uploading the commission publicly while it’s still unreleased from the Artist’s Paywall site(s).
*NB for Commissions that are inherently NSFW: The Client agrees to let the Artist create a SFW version of the commission that they can upload publicly.
Rights to the Commission

*Personal use: The client may reupload the commission, use it as an icon, print it out for personal non-monetary use, etc.
Artist credit is required on all social media where the commission is used.

I.e: in the image itself, description of the post, or in a comment underneath the original post, “Art © Ima_bunbun on twitter.”

*Commercial use: Price depends on the scale and nature of the Commercial use. The Client may discuss with the Artist to reach an agreement. Commercial use includes, but is not limited to;

Printing to sell physical merchandise, using the commission to promote sites and projects the Client profits from, streaming assets, gaming assets, and using the commission for other means with the intent to gain profit.

Credit for the Artist’s work is still required.
THE CLIENT MAY NOT:

Alter the commission without the Artist's consent.

Include any of the Artist’s work in database and/or AI image portfolio's, nor in any future inventions within the space.

Use ANY artwork made by the Artist in any block-chain related technology, including NFTs, cryptocurrency or future inventions within the space.

Use the commission to create any derivative works or repurposed assets
-
Use the commission for any commercial purposes outside of the initial intended use agreed upon between the Parties.
DO NOT SAVE NOR REPURPOSE THE ARTIST’S WORK FOR NON LICENSED USE.
The Client may contact the Artist to acquire said license.
If the art were to be stolen or otherwise misused without permission, the Artist is eligible to prosecute the Client by means of legal action within the courts of Norwegian Law.
Artist's Rights
The Artist reserves the right to…

Refuse their service, and/or cancel the commission.

Post approved drafts of the commission to any of their platforms.

Stream the commission publicly and/or post recordings of it.
-
Post alternates of the image behind a paywall on websites such as, but not limited to, Patreon and Gumroad.
-
Use rejected sketches of commission work for future illustrations such as, but not limited to, other art projects, commissions, bases & YCH auctions.
-
Alter and change their Terms of Service as they see fit.

Retain the rights © to the artwork, which includes publishing the artwork in an art book, posting the image to my public gallery, portfolios, etc.
Refunds
Due to transactional fees, the Client may only receive a 90% refund of the original payment. This 90% is referred to as a “full refund”.
The Artist may only issue a full refund if…

The commission is canceled on either side before any progress has been made.

The Artist cancels the commission during the refined sketch.
The Artist may only issue a partial refund if…

The Artist cancels the commission during the lineart stage.

The Client cancels the commission during the rough drafts.
Declined commissions
The Artist reserves the right to decline commissions without providing an explanation to the Client.
Partaking in any of the listed actions below is considered a breach of contract, and will terminate the commission immediately. Furthermore, the Client will be blacklisted from working with the Artist.

Harasses or displays inappropriate behavior towards the Artist.

Attempts to haggle, devalue or otherwise show contempt over set commission prices.

Places an order using another person's character(s), without consent from said person.

Places an order for a NSFW commission while being under the age of +18.

Places an order for a commission depicting illegal acts, i.e:
-
Minors being exploited.
-
Discriminatory content such as racism, hate crime, sexism & anti-LGBTQ+
-
Hate-fueled art aimed at a specific person or group of people.
